The Government has issued Decree No. 284/2026/ND-CP on administrative penalties for violations regarding crypto assets and the crypto asset market.
Accordingly, a fine ranging from VND70 million to 100 million ($2,660 – 3,800) will be imposed on organizations issuing crypto assets that violate regulations on foreign ownership of assets used as the basis for issuing crypto assets.
A fine ranging from VND100 million to 150 million ($3,800 – 5,700) will be imposed on organizations issuing crypto assets that provide inaccurate, incomplete, or untimely information, causing misunderstanding for state management agencies, crypto asset service providers, or investors.
A fine ranging from VND150 million to 200 million ($5,700 – 7,600) will be imposed on organizations issuing crypto assets that commit one of the following violations: offering or issuing crypto assets to entities not in accordance with regulations; offering or issuing crypto assets without meeting the conditions specified in Article 5 of Resolution No. 05/2025/NQ-CP; failing to publish the prospectus and related documents on the websites of crypto asset service providers and the issuing organization, as required under Clause 3, Article 6 of Resolution No. 05/2025/NQ-CP; and failing to comply with the information disclosed in the prospectus for offering and issuing crypto assets.
Advertising related to crypto assets
For violations in organizing crypto asset trading markets, fines ranging from VND180 million to 200 million ($6,800 – 7,600) will be imposed for the following acts: providing services related to crypto assets without being licensed to operate a crypto asset trading market; and advertising or marketing related to crypto assets without being licensed to operate a crypto asset trading market.
Crypto asset transactions
A fine ranging from VND30 million to 50 million ($1,140 – 1,900) will be imposed on domestic investors who trade crypto assets without going through licensed crypto asset service providers authorized by the Ministry of Finance, as stipulated in Clause 2, Article 7 of Resolution No 05/2025/NQ-CP.
A fine ranging from VND70 million to 100 million ($2,660 - 3,800) will be imposed on domestic investors who trade crypto assets offered or issued to foreign investors, as stipulated in Clause 1, Article 6 of Resolution No 05/2025/NQ-CP.
A fine ranging from VND50 million to 70 million ($1,140 – 2,660) will be imposed on crypto asset service providers that fail to verify the identity of investors opening accounts.
A fine ranging from VND150 million to 200 million ($5,700 – 7,600) will be imposed for acts of illegally collecting, storing, exchanging, buying, selling, gifting, or publicizing crypto asset account data and information.
The decree will take effect from September 1.
