On the morning of October 26, at its ongoing 2nd Session, the 16th National Assembly listened to the presentation and verification report on the draft Law amending and supplementing several articles of the Law on Management and Use of Weapons, Explosives, and Supporting Tools, and the Law on Fire Prevention and Fighting and Rescue.
General Luong Tam Quang, Member of the Politburo and Minister of Public Security, who spoke on behalf of the Government as authorized by the Prime Minister, presented a summary of the draft amendment to the Law on Fire Prevention and Fighting and Rescue, which consists of three articles.
Notably, the draft proposes amendments and supplements to 12 articles of the Law.
Firstly, it proposes abolishing the procedure for inspecting fire safety acceptance and implementing post-inspection combined with checking compliance with legal regulations on fire safety acceptance by investors, property owners, and vehicle owners.
Secondly, it suggests removing the licensing procedure before market circulation for fire prevention, fighting, rescue vehicles, and fire-resistant materials and components, managing fire prevention, fighting, and rescue vehicles according to product and goods quality regulations.
Thirdly, it proposes technical amendments and supplements to ensure consistency with related laws.
In presenting the summary verification report on the draft Law (amended), Lieutenant General Le Tan Toi, Chairman of the National Assembly's Committee on National Defense, Security, and Foreign Affairs, stated that the Committee agrees on the necessity of enacting the law as proposed by the Government.
The Committee also agrees with the amendments and supplements to several articles of the Law on Fire Prevention and Fighting and Rescue. However, it recommends clearly defining the legal responsibilities of investors, owners, heads of establishments, households, and vehicle owners in adhering to initial fire safety designs and maintaining safety conditions according to standards and technical regulations.
Additionally, it emphasizes clearly identifying the entities responsible for deciding to put vehicles into use and the capacity of independent consulting and acceptance units to prevent fire and explosion risks.
It also suggests adding mechanisms to resolve obstacles for provinces and cities following administrative mergers in July 2025 to facilitate the implementation of regulations for existing establishments that do not meet fire safety requirements, allowing the application of technical solutions to enhance safety according to the law. It aims to complete the legal framework when transitioning from pre-inspection to post-inspection to ensure feasibility and thoroughly review transitional provisions to avoid legal gaps.
A draft law, that proposes amendments and supplements to 14 articles of the Law on Management and Use of Weapons, Explosives, and Supporting Tools, decentralizes the authority to revoke weapons, military explosives, supporting tools, and licenses, certificates, and permits for managing and using weapons, explosives, explosive precursors, and supporting tools within the management scope of the Ministry of Public Security to authorized agencies as prescribed by the Minister of Public Security.
Simultaneously, it proposed abolishing the procedures for issuing, reissuing, and revoking business licenses for supporting tools. It also proposed removing the provisions at point b, clause 2, Article 9 to align with the regulation not to implement the procedures for issuing, reissuing, and revoking business licenses for supporting tools and the provisions on approval documents for fire safety acceptance results at point đ, clause 1, Article 39 to align with the draft law when abolishing the inspection of fire safety acceptance in the current Law on Fire Prevention and Fighting and Rescue.
The draft also proposed abolishing the regulation on conditions for only conducting business in supporting tools according to the business license for supporting tools of organizations and enterprises. It specifies more clearly the procedures for issuing export and import licenses for industrial explosives.
The verification report by the Committee on National Defense, Security, and Foreign Affairs agrees with the amendments and supplements to several articles of the Law on Management and Use of Weapons, Explosives, and Supporting Tools. However, it recommends reviewing to ensure consistency between the amended contents when abolishing the case of revocation and abolishing business licenses for supporting tools.
It clarifies the conditions for implementation when shortening the time for issuing business licenses for explosive precursors and importing and exporting explosive precursors to three working days.
It also identifies the conditions and responsibilities of organizations and enterprises, the mechanism for inspection, and handling violations when abolishing the procedure for issuing business licenses for supporting tools; simultaneously, it adds transitional provisions for licenses issued previously.
